Online Agreement

  • 1. BOOKING AND PAYMENT

    A non refundable retainer equal to 30% of the total fee is required to reserve the wedding date. The remaining balance shall be paid according to the payment schedule stated in the accepted proposal and, unless otherwise agreed in writing, no later than the wedding day. Any payment not received within 7 days of the agreed due date may be subject to a late payment fee of €50 and/or interest on the overdue amount until paid in full. The Photographer reserves the right to suspend further services, editing, album design, or gallery delivery until all outstanding amounts have been paid. No date is held without both a signed agreement and the retainer. Any additional coverage, albums, prints, travel costs, second photographers, or bespoke services requested after booking will be invoiced separately.

  • 2. SCOPE OF SERVICES

    The Photographer will provide wedding photography services in accordance with the collection or custom proposal accepted by the Clients. Coverage includes the Photographer’s time, creative direction, image curation, professional editing, and final delivery in the format described in the accepted proposal.

    The Photographer retains full artistic and editorial discretion in relation to composition, sequencing, framing, cropping, colour treatment, and final image selection. The Clients confirm that they have reviewed the Photographer’s portfolio and are engaging the Photographer specifically for that artistic style and storytelling approach.

  • 3. EXCLUSIVE COVERAGE AND COOPERATION

    The Photographer shall be the exclusive professional still photographer retained for the event. Guests may take photographs for personal use, provided they do not obstruct, direct, or interfere with the Photographer’s work or with key moments of the day.

    The Clients agree to provide an accurate timeline, communicate any essential family groupings or sensitive circumstances in advance, and nominate a person who can help gather family members for formal photographs. The Photographer is not responsible for missing individuals who are unavailable, unidentified, or unwilling to participate when requested.

  • 4. VENUE CONDITIONS, TRAVEL, MEALS, AND OVERTIME

    The Photographer is not responsible for limitations caused by venue rules, officiant restrictions, guest interference, weather conditions, delays, poor lighting, or any circumstance outside the Photographer’s reasonable control. Such limitations may affect the ability to capture specific images or moments.

    Where travel, accommodation, parking, access fees, ferries, or similar expenses are required, these costs shall be borne by the Clients unless already included in the accepted proposal. For continuous coverage exceeding six hours, the Clients shall provide the Photographer with a hot meal and water at a suitable time during the event.

    Additional coverage beyond the agreed hours may be provided only if requested by the Clients and if feasible on the day. Any overtime will be charged at the rate stated in the accepted proposal or, if no rate is stated there, at €250 per additional hour or part thereof.

  • 5. DELIVERY, EDITING, AND ARTISTIC INTEGRITY

    The Photographer will deliver a curated final gallery of professionally edited images. Delivery timelines may vary according to season and workload, but the Photographer aims to deliver the final gallery within approximately eight to twelve weeks after the event, unless otherwise stated in writing.

    The delivered gallery constitutes the final artistic product. Minor adjustments may be requested within fourteen days of delivery if they are reasonable and limited in scope. Extensive re editing, selective recolouring, beauty retouching, or stylistic changes are not included unless expressly agreed and may be charged separately.

    RAW files, unedited images, rejected frames, and partially processed material are never delivered. The Photographer may remove images containing blinks, duplicates, test frames, technical imperfections, or material that does not meet the Photographer’s professional standards.

  • 6. COPYRIGHT, PERSONAL USE, AND PORTFOLIO USE

    All photographs remain the copyright and intellectual property of the Photographer. The Clients receive a non exclusive licence for personal use only, including downloading, sharing with family and friends, printing for private display, and posting online for non commercial purposes.

    The Clients may not sell the images, submit them for commercial publication, or alter them in a way that misrepresents the Photographer’s work. Filters, heavy edits, screenshots, or other modifications that materially change the visual style should not be applied to the delivered files when shared publicly.

    Unless the Clients notify the Photographer in writing before the wedding day that they require privacy, the Photographer may use selected images for portfolio, website, social media, studio samples, awards, exhibitions, blogs, and editorial submissions. Any privacy request shall apply only to future promotional use and does not restrict archival storage or private proofing necessary for the performance of this agreement.

  • 7. ARCHIVING AND CLIENT BACKUP

    The Photographer will keep an archive copy of the delivered images for a minimum period of twelve months from the date of delivery. After that period, continued storage is not guaranteed. The Clients are solely responsible for downloading, saving, and backing up all delivered files in more than one location.

  • 8. CANCELLATION, POSTPONEMENT, AND SUBSTITUTION

    If the Clients cancel the booking, all payments already made remain non refundable to the extent permitted by law, since the Photographer will have declined other commissions for that date and committed preparation time to the event. If the Clients request a postponement and the Photographer is available on the new date, payments already made may be transferred once to a new date within twelve months of the original event date.

    If the Photographer is unavailable for the rescheduled date, or if the postponement exceeds twelve months, the matter shall be treated as a cancellation. In the unlikely event that the Photographer is unable to attend due to serious illness, accident, bereavement, or other genuine emergency, the Photographer may appoint a replacement professional of similar standing where reasonably possible, or otherwise refund all sums paid.

  • 9. LIMITATION OF LIABILITY AND FORCE MAJEURE

    The Photographer will use professional grade equipment and reasonable backup procedures. However, in the unlikely event of image loss, corrupted files, camera malfunction, theft, accidental damage, or other failure beyond the Photographer’s reasonable control, the Photographer’s liability shall be limited to the total amount actually paid under this agreement.

    The Photographer shall not be liable for indirect loss, emotional distress, consequential damages, or any amount exceeding the sums paid by the Clients. Neither party shall be considered in breach where performance is prevented or materially delayed by events outside reasonable control, including severe weather, natural disaster, fire, public health restrictions, transport failure, civil disturbance, or sudden medical emergency.

  • 10. GOVERNING LAW AND FINAL TERMS

    This agreement is governed by the laws of Italy. Any dispute shall first be addressed in good faith through direct communication. If no amicable solution is reached, the dispute shall be submitted to the competent Italian court.

    This document, together with the accepted proposal or quotation, constitutes the entire agreement between the parties and supersedes prior discussions or informal messages relating to the booked services. Any amendment must be confirmed in writing by both parties.

  • 11. ELECTRONIC SIGNATURES

    This agreement may be executed electronically and in counterparts. Signatures transmitted through an electronic signature platform or delivered as PDF copy shall be deemed valid and enforceable to the fullest extent permitted by law.
