This agreement cannot be transferred or assigned to any third party by either Giuliano Bausano or Client without written consent of both Parties.

This is the entire agreement between Giuliano Bausano and Client and supersedes all previous agreements. It cannot be altered without written consent of both Giuliano Bausano and Client.

No part of any order, including previews, will be delivered until the balance is paid in full. The photos will be delivered through a private online gallery. Delivery will occur as soon as possible and typically within 4 to 9 weeks after the event, depending on seasonal workload. Giuliano Bausano is committed to ensuring the highest quality in post-production and editing, which may require additional time during peak season.

If notice of cancellation is given more than six (6) months before the event, the deposit is refundable, else it is not and in case of cancellation three (3) business weeks before the shoot date, Client will be charged 50% fee. Client is also responsible for payment of all shoot-related expenses incurred by Giuliano Bausano up to the time of cancellation. For cancellations or postponements required other than inclement weather which is addressed below, or the fault of a third party, Giuliano Bausano will charge no additional fee, but Client will pay any and all applicable expenses incurred by Giuliano Bausano related to the assignment, up to time of cancellation.

This agreement constitutes an order for photography or videography services, and any additional services outlined above in Package. It is agreed to by both parties, Giuliano Bausano and Client, as described above. Client agrees to pay Total Amount by the Final Payment Due By Date as defined above.

The Client gains exclusive rights to the digital and physical photos, footage, online and in print. No rights herein may be transferred or assigned in whole or in part.

In the event of non-payment or other breach of this Agreement by Client, Client shall pay all of Giuliano Bausano’s costs and expenses incurred in connection with enforcement of the terms of this agreement or incurred as a relation to the assignment including Giuliano Bausano’s reasonable legal fees if applicable.

Digitally signing this agreement has the same effect as manually signing a paper original.

Client will be charged 100% fee and expenses for any re-shoot required by Client. For any re-shoot required because of force majeure, (other than inclement weather which is addressed below) or the fault of a third party, Giuliano Bausano will charge no additional fee and Client will pay all expenses. If Giuliano Bausano charges for special contingency insurance and is paid in full for the shoot, Client will not be charged for any expense covered by insurance. A list of exclusions from such insurance will be provided on request.

To preserve the artistic integrity and quality of the services provided, the Client agrees that no other professional photographer or videographer shall be hired or allowed to perform the same or similar services during the event (whether it is a wedding or any other type of assignment), without the prior written consent of Giuliano Bausano.
This exclusivity is necessary to avoid operational interference and to ensure the final work reflects the photographer’s vision and standards.

Giuliano Bausano agrees to keep a backup of the final edited photos for a minimum of 6 months from the date of delivery. Raw files are not included in the service and will not be provided unless previously agreed in writing. It is the Client’s responsibility to download and safely store their images upon delivery.

Client agrees to ensure that all guests and participants behave respectfully towards Giuliano Bausano and any of his collaborators. Giuliano Bausano reserves the right to cease coverage if any situation arises that puts his physical safety or equipment at risk. In such case, no refunds will be issued.

Unless otherwise requested in writing by the Client, Giuliano Bausano retains the right to use a selection of the photos and/or videos for portfolio, website, exhibitions, social media and promotional materials, always in a respectful and professional manner.
